
I believe that it is not easy to just create a Jan Lokpal bill as we wish and implement it as effectively as we think and eliminate the corruption. Of course Anna Hazare is a great person and his motives are really great and I do support him. But I feel that he strives towards a vision, as far as I understood from his demands, is very difficult in real when it comes to implementation. There are some reasons by which I believe so and in accordance with my understanding (May be because my understanding is wrong and pardon me if I am wrong).
In India, We have a written constitution and by that constitution people bears the supreme power and because of that, the Parliament is the supreme body of our country. Any body formed by the executive order cannot question the integrity of the Parliament or its executive. In other words any body formed by the executive order can only be advisory in nature otherwise we have to amend the constitution accordingly through a lengthier process and which needs the support of both the House of People and the Council of States (which may make things difficult for Anna Hazare)
If you ask me, I will say, the most corrupted section in India is the Judiciary. Believe it or not, it is a reality. Every Politician is not corrupt. For example I believe Leaders like Sonia Gandhi, Manmohan Singh, L K Advani, Sushma Swaraj, Vrinda Karat are not corrupt (You may have your own perception about this). The corruption in Political level deals with money which does not affect common man directly. But the corruption in judiciary does affect the people directly and it affects the dignity of the human being severely by which it eliminates the very reason for living and it is violation of human rights. The common people/ Poor people in India cannot even imagine the number of zeros in 1.76 lakh crore of 2G scam but all they think and all they need is a life to live with dignity in this country. Judiciary and the law establishments particularly in the lower level are making this very difficult. This is a very serious problem in our country. So I don’t know how much we can keep politics and corruption out of Jan Lokpal also how Jan Lokpal will replace the corrupt judicial systems in the cases of corruption.
Every selection in this Jan Lokpal do need a political will directly or indirectly as politicians represent the people and people are the supreme power as I mentioned earlier. So it is very difficult to avoid political interference even in the creation of Jan Lokpal even if politicians are not directly involved. The Politico - Judicial nexus is very strong in this country so that it is very difficult to make a powerful body without its interference. So even if the process is transparent, it doesn't mean the persons appointed are not partial
Nobody will care about an injustice done to a common man or a group of common people, if the opposition is strong and influential, even by the Jan Lokpal. We and the media care about mostly the scams made by the Ministers and top politicians. We are very hypocritical. So there arises a Big Question “How the Jan Lokpal is going to help the common people/poor people with just transparency in process?"
It has been said that the Jan Lokpal will have the power to accept complaints from general public against the bureaucrats also. There arise a lot of questions. Do we have an estimate of how much complaints the Jan Lokpal will get if this is being carried out? What will be the volume? How they are going to complete the investigation in one year and trial in one year if the volume of complaints received is so enormous? Who is going to assist them in the implementation of their orders? Who will be the appealate authority if the prosecution or the defence is not satisfied by the Jan Lokpal decision and what about the time taken in the appealete authority? What would be the provisions in the bill to ensure that the powers are not being misused for one’s personal agenda?
There are many other questions to be answered on the implementation side. What would be the difference between the Jan Lokpal and present judicial system in India? Will it be given extraordinary powers to take cases against People’s Representatives? Etc. More over even the Jan Lokpal is also curative in nature, it does not prevent any corruption so how such a special body is going to make any difference that our courts can not?
The main solution which I believe is to educate people against the corruption. For that we have to improve the living conditions of the people. The educated People of India have to realize that elimination of corruption will not be possible with just creating a statutory body or Satyagraha by one person and the struggle by his supporters. We have to mobilize masses which are not even aware of this movement or just talking about Anna Hazare and his good deeds. This country does not need any Bloggers or Supporters who lend their support through internet or Visual Media in a larger perspective. We shall be able to make people aware of this social evil and fight against it at our own respective places. We shall give time ourselves to think about what can be done by us rather than airing our views. We should know about the NGOs who fight against corruption and we should try to be a part of it directly. Otherwise this feeling what we have now is going to end sooner or later. We should try to keep the fire inside us everyday till our country becomes non corrupt.
The main success of Anna Hazare of course by the help of media, is that he was able to show the Government of India that the people of India will not tolerate whatever they are doing for all the time. The People are watching each and every action of the Government and if the Government does not realize the importance of people, the day will come when the People of India themselves topple the whole corrupted machinery and do the corrective action with their own hands. The sole of Mahatma Gandhi and way shown by him is there to guide us and we will surely win in the end.
